Article 1: Definitions<\/h3>\n\n\n\n

Whenever the following terms are used in these General Terms and Conditions of Sale (hereinafter the \u201cT&Cs\u201d) or in connection with their performance, they shall have the meaning defined below:

\u201cGBP\u201d means the simplified joint-stock company Les Grands Bateaux de Provence, registered with the Avignon Trade and Companies Register under no. 334 875 242, whose registered office is located:

\u201cCustomer\u201d means the consumer or non-professional ordering the Services under these T&Cs;

\u201cService(s)\u201d means the various cruises open to the public and the associated services organised by GBP and ordered by the Customer from GBP under these T&Cs.

\u201cContract\u201d means these T&Cs as accepted by the Customer when booking or purchasing a Service.

\u201cParty\u201d means GBP or the Customer individually, and \u201cParties\u201d means GBP and the Customer collectively.<\/p>\n<\/div>\n\n\n\n

\n

Article 2: Purpose and scope<\/h3>\n\n\n\n

Any booking or purchase of a Service automatically entails the Customer\u2019s unreserved acceptance of these T&Cs.

GBP makes these T&Cs available on its website so that the Customer can read them before booking. These T&Cs may be amended. The version applicable to the Service is the one in force on the day of the order.

Booking, ticket purchase and the performance of the Services are subject to these T&Cs, which set out all the rights and obligations of the parties and prevail over any document, leaflet or advertisement issued by GBP or the Customer, the latter not being enforceable against GBP. These T&Cs apply only to cruises open to the public. If you wish to book a private event, please refer to the specific Events T&Cs for private events.

If any clause of the contract is declared illegal, invalid or unenforceable, the remainder of the Contract shall continue to apply.
The fact that GBP or the Customer does not exercise any of the rights conferred by the Contract shall not be interpreted as a waiver by that party of the right to exercise it in the future.<\/p>\n<\/div>\n\n\n\n

Article 3: Booking or purchasing a ticket<\/h3>\n\n\n\n


3.1 Purchase arrangements
<\/strong>
Cruise tickets can be purchased online via the GBP website, directly at the reception desk on GBP\u2019s premises or from our authorised resellers. Bookings of Services or purchases of individual tickets or tickets for groups of fewer than 20 people are only considered final once GBP has received full payment for the Service, followed by written confirmation sent by email for online purchases, or the issue of the ticket for on-site purchases.


3.2 Payment and issue of the ticket
<\/strong>
Online payment for the order is handled by the secure payment system, which allows the Customer to pay under the conditions set out in article 4 hereof. Beforehand, the Customer must tick the box confirming that they have read and accept these T&Cs. Once payment has been made, a screen summarising the Customer\u2019s order appears, with a link allowing the Customer to download and\/or print the PDF version of the ticket purchased.

GBP will then send the Customer, at the email address entered when ordering, confirmation of the order together with the ticket. If the Customer does not receive the tickets, it is their responsibility to contact GBP using the details given in article 1 hereof so that a confirmation email containing the tickets can be resent. GBP shall under no circumstances be liable if the Customer does not receive the confirmation email due to an error in the details they entered. Computerised records, kept in GBP\u2019s IT systems under reasonable security conditions, shall be deemed proof of communications, orders and payments between the parties and may be produced as evidence.

3.3 Ticket validity
<\/strong>
The applicable date or period of validity is shown on each electronic ticket issued. Electronic tickets are non-refundable. Exchange vouchers presented by the Customer will only be accepted if they have been issued by an intermediary approved by GBP. A ticket purchased on GBP\u2019s website is only valid on the day of the booked Service.

3.4 Minimum number of passengers
<\/strong>
For a departure to go ahead: sightseeing cruises open to the public require a minimum of 50 passengers; lunch and dinner cruises open to the public require a minimum of 20 passengers; cruise excursions open to the public require a minimum of 50 passengers and can only accept passengers within the boat\u2019s regulatory capacity.

3.5 Bookings for groups of 20 or more (see the group T&Cs)
<\/strong>
These Services cannot be purchased directly from the online ticket office but must be the subject of a booking request to GBP. GBP will provide a quote stating the total amount of the booking and the date and time booked. Booking is compulsory and will only be taken into account once GBP has received the quote signed with the words \u201cbon pour accord\u201d (approved), together with payment of the flat-rate group deposit, corresponding to 50% of the total amount of the booking. The balance of the Service must be paid no later than 5 days before the Service. The Customer acknowledges that if the price (deposit and balance) is not paid on the exact due dates set out in these T&Cs, the contract will be terminated automatically through the Customer\u2019s fault and the services will be deemed cancelled by the Customer in application of article 4.1.

GBP reserves the right to refuse boarding to minors under 16 who are not accompanied by adults. Sale of alcohol \/ combined tickets. The boats are equipped to welcome people with reduced mobility. However, their presence must be reported at the time of booking so that GBP\u2019s teams can reserve the best possible place on board for them and guarantee optimal accessibility.

3.6 Prices and payment
<\/strong>
Prices charged by GBP are stated in euros including all taxes and are set on the basis of the price conditions in force on the day of the order. They are displayed at reception for sales made on site and available on GBP\u2019s website for online sales. For groups of more than 20 people, the prices charged are stated, for each booking request, in the quote sent by GBP. Prices are subject to VAT. Prices may be revised at any time by GBP without prior notice, it being specified that the applicable price is the one in force on the day the ticket is purchased or, for a booking for a group of more than 20 people, on the day the Customer signs the quote.

Prices will be adjusted automatically if any applicable taxes or charges are introduced or modified before the sale or booking. Payment may be made at reception in cash (within the regulatory limit), by bank card or by gift cards accepted by GBP, and online by bank card or any other payment method accepted by GBP or, for groups of more than 20 people, according to the payment terms stated in the corresponding quote. A Customer paying by bank card undertakes to use a card of which they are the holder. GBP cannot be held liable in the event of fraudulent use.

Online payment is made through a secure system using the SSL (secure socket layer) protocol, so that the information transmitted is encrypted by software and no third party can access it while it travels over the network.<\/p>\n<\/div>\n\n\n\n

Article 4: Cancellation<\/h3>\n\n\n\n


4.1 Cancellation by the Customer <\/strong><\/span>
The Customer may cancel all or part of their booking under the following conditions: <\/span>
Any cancellation must be notified to Les Grands Bateaux de Provence in writing; the date on which the cancellation is received will be used to apply the cancellation fees set out below: <\/span>\u2022 Cancellation up to 10 (ten) days before departure: free of charge. <\/span>\u2022 Cancellation between 30 (thirty) and 10 (ten) calendar days before the scheduled date: a penalty of 30% (thirty per cent) of the price of the service including tax is payable by the Customer, whatever the amount of the service. <\/span>\u2022 Cancellation less than 10 (ten) calendar days before the date of the service, or no-show by the Customer on the day: a penalty of 100% of the price of the service including tax is payable by the Customer; Les Grands Bateaux de Provence reserves the right, where applicable, to resell the unused places. Penalties remain in all cases payable to Les Grands Bateaux de Provence. <\/span>

4.2 Cancellation by GBP <\/strong><\/span>
As cruises are subject to the rules applicable to inland navigation, and access to the boarding quay may be prohibited by the competent authorities, GBP reserves the right to assess whether or not the river is navigable and to modify the Services without notice or compensation (in particular the route, duration, times, boat, etc.) or to cancel them at any time, including on the day of departure, in application of the above rules or in the event, among others and without limitation, of a pandemic, terrorist acts or threats, river flooding, floods, bad weather, storms, instructions from the authorities (government decision, prefectoral order, etc.), mechanical incidents and, in general, any event beyond GBP\u2019s control and\/or likely to endanger the safety of Customers, people and goods carried. If a cruise is cancelled by GBP for any reason whatsoever, in particular in the cases referred to above, the Customer shall be entitled, as far as possible and at GBP\u2019s discretion, to replacement of the Service not provided with an equivalent service and, failing that, to termination of the contract and reimbursement of the sums already paid. <\/span>

4.3 Postponement <\/strong><\/span>
If the Customer requests a postponement, GBP will endeavour, subject to availability, to offer a new date that suits the Customer. However, the possibility of postponement remains at GBP\u2019s discretion, with no commitment on its part as to the outcome. If the postponement cannot take place, the Customer may choose to keep the Service or to cancel it under the conditions set out in article 4.1.<\/span><\/p>\n<\/div>\n\n\n\n

Article 5: Combined tickets<\/h3>\n\n\n\n


GBP sells combined tickets allowing the Customer to benefit from a GBP service and a partner\u2019s service. The Customer accepts that, when purchasing a combined ticket, GBP is only responsible for the performance of its own service and can in no way be held liable for any damage caused by the performance or non-performance of the partner\u2019s service. For clarity, if the partner is unable to perform its own service, GBP will not be required to reimburse the Customer for the partner\u2019s service.

Article 6: Regulations applicable to cruises<\/h3>\n\n\n\n


GBP undertakes to use appropriate means to ensure that cruises run smoothly under the conditions set at the time of booking, and declares that it has taken out the insurance necessary for its activities.

The passenger or the complete group of passengers must arrive at the boarding point of GBP\u2019s boats at the boarding time given to the Customer in advance. If the passenger or group of passengers arrives less than 30 minutes beforehand or after the boat has left, they may, where applicable, be admitted on the next departure offering the same service, depending on available places, without any right to reimbursement or compensation. The Customer agrees not to consume food or drinks not sold on board during the service. GBP sells food and drinks on board. Depending on the ticket purchased, drinks may be included in the ticket price or must be paid for on the spot. The Customer acknowledges and accepts that the sale and consumption of alcoholic drinks is prohibited for persons under eighteen (18) years of age, and GBP shall in no event be liable if a minor consumes alcohol on board.

GBP or its service provider reserves the right to refuse to serve alcoholic drinks to persons unable to prove their age, without this giving rise to any reimbursement or compensation.

GBP reserves the right to refuse boarding to, or require the disembarkation of, passengers whose behaviour (for example drunkenness or aggressive or disrespectful behaviour) is likely to disrupt the cruise and\/or the safety or integrity of the boat. No animals are allowed on board (except small dogs or dogs accompanying visually impaired people), nor any equipment which, in the opinion of the crew, could prove dangerous for the crew or passengers. All indoor areas of our boats are non-smoking. Naked flames or gas are strictly prohibited on all our boats.

From the moment they are invited to board, each passenger must strictly follow the safety instructions set out in the safety file and\/or given by the boat\u2019s crew, and is responsible for their own safety and that of the persons in their care and\/or of the property (clothing, luggage and other personal belongings) they own, hold or look after; in particular, each passenger must not enter unauthorised areas of the boat, including the engine room and the wheelhouse.
<\/span><\/p>\n<\/div>\n\n\n\n

Article 7: Liability \u2013 Insurance<\/h3>\n\n\n\n


The Customer is liable for all material damage or personal injury suffered by GBP and\/or third parties caused by them, and for damage resulting from an act committed by them and, in general, by any person for whom they are responsible (accompanying minor, member of their group, etc.). GBP reserves the right to invoice the Customer for any material damage caused on board by them or by a member of the group.

GBP declines all liability and cannot be required to pay any compensation in the event of: loss, fall, theft or damage to passengers\u2019 clothing, hand luggage and other personal belongings; failure by the Customer and\/or their group to comply with these T&Cs and with general and specific police regulations, without prejudice to any damages it may claim for the loss suffered as a result of such non-compliance;

Changes to the times, route, boat and\/or duration of the cruise due to force majeure or any case described in article 5.3, or due to instructions given by the navigation authorities.

If GBP is held liable, only holders of a ticket validly issued by GBP may claim compensation. GBP declares that it holds comprehensive insurance cover for its activity, including operating liability insurance and shipowner\u2019s liability insurance (P&I).
<\/span><\/p>\n<\/div>\n\n\n\n

Article 8: Personal data<\/h3>\n\n\n\n


The personal data provided by the Customer to GBP are necessary to process their request, perform the Service and draw up invoices. They are processed by GBP as data controller. They may be passed on to GBP\u2019s partners responsible for performing, processing, managing and paying for the Services.

GBP hereby undertakes to comply with the laws and regulations applicable to the protection of personal data, in particular European Regulation 2016\/679 of 27 April 2016 (the \u201cGDPR\u201d) and French law no. 78-17 of 6 January 1978 as amended by law no. 2018-493 of 20 June 2018. Article 9: Complaints \u2013 Mediation<\/h3>\n\n\n\n


Commercial complaints or complaints about the quality of the Services provided must be sent by registered letter with acknowledgement of receipt to the following address:

no later than 15 days from the date of the Service.

Complaints will only be examined by GBP if the difficulties concerned were reported on site, so that they could be remedied and any loss claimed by the Customer limited. In accordance with articles L.611-1 et seq. of the French Consumer Code, GBP offers its consumer Customers effective access to alternative dispute resolution procedures. The alternative dispute resolution body proposed is the Centre National de M\u00e9diation des Avocats (CNMA).

If GBP cannot resolve a dispute through its internal procedure, or if the consumer is not satisfied with the solution proposed, and if the complaint is less than a year old, the Customer may contact this body:

Article 10: Applicable law and jurisdiction<\/h3>\n\n\n\n


In the event of a dispute relating to these T&Cs and to the cruises and related services they govern, the parties agree that French law alone shall apply. Disputes between GBP and its Customers registered with the Trade and Companies Register shall be submitted to the Paris Commercial Court. For disputes between GBP and a consumer Customer, in accordance with article R.631-3 of the French Consumer Code, the Customer may bring the matter before either one of the courts with territorial jurisdiction under the Code of Civil Procedure, or the court of the place where they lived at the time the contract was concluded or the damage occurred.<\/a><\/span><\/p>\n<\/div>\n\n\n\n
